The Ministry of Finance is working on rules that would introduce an exception to the National e-Invoicing System (KSeF) for micro-entrepreneurs: if the value of invoices issued outside KSeF does not exceed PLN 10,000 gross in a given month, the business may not be obliged to register them in the system. On the one hand, this is a breather for the smallest firms; on the other, it may create new traps and risks.
What is this "PLN 10,000 limit"?
- The draft rules provide that micro-businesses will be able to issue invoices outside KSeF as long as the total gross value of those invoices in a month does not exceed PLN 10,000.
- The limit applies to the sum of all invoices issued outside KSeF, not to individual documents - even a large invoice can remain "outside the system" as long as the total of all such invoices does not exceed the threshold.
- The exception is meant to apply during a transitional phase, until KSeF becomes mandatory for the smallest entities as well (scheduled for January 2027).
- The idea does not mean complete freedom - once the limit is exceeded, invoices must be issued in KSeF and you cannot go back to the old way of invoicing.
Who does this limit give hope to?
- Sole proprietorships (JDG) and micro-businesses with low monthly turnover.
- Seasonal businesses that occasionally make larger sales but stay below the threshold for most months.
- Those who worry about the cost of implementing KSeF and want time to adapt without abrupt consequences.
But the risks are significant too
- Exceeding the limit, even by a small amount, automatically forces you to use KSeF - a regulatory jump in the middle of the month.
- The need to constantly monitor the total of invoices "outside the system" - additional accounting duties and a risk of errors.
- Potential penalties or corrections if the tax office decides that the threshold was exceeded and the invoices were not entered into KSeF.
- This tool can act as a kind of "trap", in which even a one-off higher-value sale catches the business owner out with an obligation to migrate documents to KSeF.
How to prepare and protect yourself
- Monitor the totals of invoices outside KSeF - use automated systems so you know when you are approaching the threshold.
- Adapt your accounting system - it must distinguish between KSeF and non-KSeF invoices and add up their value.
- Plan your sales - if you expect a larger order, plan to invoice it through KSeF to avoid exceeding the limit.
- Structural consultation - consider whether part of the business could be moved to a structure that will enter KSeF sooner, to avoid a large volume of documents outside the system.
- Formal safeguards - well-drafted contracts, sales documentation and correction mechanisms in case invoices need to be migrated.
Our comment
The PLN 10,000 limit is a gesture towards micro-entrepreneurs, but it is also a subtle trap. It offers flexibility, but requires discipline in tracking invoices and anticipating when you will cross the threshold. For businesses operating close to the threshold, the limit can be a source of unexpected complications.
