As the National e-Invoicing System (KSeF) is rolled out, a question comes up more and more often: what about invoices issued by foreign contractors? Do businesses have to record them in the system, and if so, to what extent?
The answer is not clear-cut. According to the Ministry of Finance, the obligation to record an invoice in KSeF depends above all on who issues it - a Polish or a foreign VAT taxpayer.
When does an invoice go into KSeF?
An invoice will go into KSeF only if it is issued by an entity registered in Poland as an active VAT taxpayer. This means that:
- a foreign contractor without a Polish tax identification number (NIP) is not required to use KSeF,
- however, if a company from another country has a Polish NIP and has registered as an active VAT taxpayer, it must issue invoices in the KSeF system.
For Polish businesses, this means they may receive invoices both in KSeF and outside it, depending on the issuer's status.
Risk and organisational chaos
For businesses, especially those engaged in international trade, this situation means potential chaos in their documentation. Companies will have to:
- run two invoicing systems in parallel - the traditional one and KSeF,
- verify the tax status of the contractor before accepting an invoice,
- adapt their accounting systems to account correctly for domestic and foreign transactions.
Inconsistent recording of invoices can lead to errors in VAT returns and, as a result, to tax penalties.
What should businesses do?
- Check the contractor's status - whether they have a Polish NIP and whether they are an active VAT taxpayer.
- Update your accounting system - so that it can handle both KSeF documents and traditional PDF/EDI invoices.
- Set internal procedures - your accounting team must know how to verify and archive foreign documents.
- Make use of automation - tools that integrate KSeF with ERP systems will help avoid errors when handling a large number of invoices.
- Seek advice from a tax adviser - especially if your company operates in several markets and accounts for VAT in more than one country.
