The zondacrypto Scandal - 4,500 BTC Without a Key and a Murky Trail

A wallet with 4,500 bitcoins - proof of solvency or an illusion of security?

In April 2026, the president of the cryptocurrency exchange zondacrypto, Przemysław Kral, publicly pointed to the bitcoin wallet address 16aEn4p6hK4FMpLtJGpoQZMZ946sDg1Z6n as proof that the exchange holds reserves securing client withdrawals. The address holds around 4,503 BTC, which at current prices is worth more than $300 million. The gesture was meant to put an end to all speculation about the platform's financial health.

Instead, it triggered an avalanche of questions. The president himself admitted that the private key to the wallet is allegedly held by the company's former president, Sylwester Suszek, who disappeared in unexplained circumstances. This means the exchange is showing a balance over which it has no actual control. Under the law and audit standards, this is a situation that should concern every client, investor and regulator.

Blockchain technology allows anyone to verify that funds exist at a given address. However, it does not allow anyone to confirm who holds the key needed to spend them. Without a cryptographic signature or a test transaction, any claim of wallet ownership remains just words - not evidence.

The wallet's history - a decade of inactivity and a troubling origin of funds

On-chain analysis reveals a remarkably simple history for this address. Almost the entire balance comes from just two transactions in March 2016: the first was for 4,434 BTC, the second for slightly over 69 BTC. Since then, not a single satoshi has been sent from the wallet. The only later activity consists of microscopic deposits of so-called dust - a technical artefact used, among other things, for tagging addresses.

Such a profile is highly unusual for an operational cryptocurrency exchange cold wallet. Professionally managed reserves require regular rebalancing of funds between wallets, processing of client withdrawals and test transactions during audits. An address that has shown no outgoing activity for more than ten years looks more like a wallet with lost access than an actively managed reserve.

Even more troubling is the origin of the funds. Cryptocurrency flow analysis tools indicate that a significant share of the trail leads, indirectly, to entities with an extremely poor reputation:

Although indirect links are not automatically proof of the crime of money laundering, a risk profile in which more than half of the trail leads to entities subject to regulatory proceedings is a serious compliance red flag. Importantly from a legal perspective, such "tainted" funds would be extremely difficult, or even impossible, to convert lawfully into fiat currencies.

Audits and financial statements - years of qualifications without resolution

zondacrypto's transparency problems did not appear overnight. The company's financial documentation has raised serious concerns among auditors for years, which has a direct bearing on the assessment of the exchange's credibility and the safety of client funds.

Timeline of audit qualifications

In 2021, the auditor declined to express an opinion on the financial statements, citing a limited scope of examination. In 2022, the qualifications concerned cryptocurrencies worth €155 million, for which there was no evidence of existence and ownership - particularly in relation to funds held by external service providers. 2023 brought the identification of crypto-assets worth €172 million, but the auditor was unable to confirm whether the company exercises actual operational control over them.

The management board then proposed replacing the standard statutory audit with a notarial certification of ownership. Under current audit standards, such a solution is highly insufficient and cannot replace a professional audit of the financial statements.

The report for 2024 revealed another troubling fact: client funds may have been used by the company for short- and long-term investments. Loan receivables rose to €93.6 million, of which €75 million was a loan denominated in cryptocurrencies. For clients who assumed their deposits were sitting safely in a cold wallet, such information may provide grounds for taking legal action.

Three scenarios - and none of them is optimistic

Based on publicly available information, three possible scenarios regarding the status of the disputed wallet can be reconstructed. Each carries different but serious legal consequences for the exchange's clients and creditors.

Scenario one: the address is a genuine historical wallet from the BitBay era, funded in 2016 and unused since. This explains the age of the funds and the lack of activity, but it does not explain why the alleged client reserve has sat dormant for a decade. A historical cold wallet is not the same as an operational reserve capable of securing withdrawals.

Scenario two: the wallet belonged to the group, but access was lost when Sylwester Suszek disappeared. In this variant, the 4,503 BTC are economically dead - for solvency purposes, an asset that is operationally inaccessible is worth the same as an asset that does not exist.

Scenario three: the address was publicly named as part of crisis communications, despite having no actual connection to the company. In that case, we would be dealing with potential fraud against clients and the market.

Each of these scenarios gains additional weight in light of the latest information: the Minister of Justice has initiated proceedings against zondacrypto with allegations of fraud and money laundering. This means the case has entered a phase in which protecting the rights of injured parties requires professional legal action.
