The National e-Invoicing System - what has changed since April 2025?
The rollout of the National e-Invoicing System (KSeF) has entered its decisive phase. From the beginning of April 2025, a second, very large group of businesses joined the platform - entities whose sales last year did not exceed PLN 200 million. This means that the obligation to issue structured invoices in XML format now covers the vast majority of Polish companies.
Contrary to pessimistic forecasts, there were no mass system failures and no paralysis of business transactions. The technological foundation of the platform withstood the load - at peak moments, the servers of the Ministry of Finance recorded millions of invoices a day. More than 311,000 businesses have already joined the system, which represents an unprecedented scale of digital transformation of the Polish tax system.
However, the absence of a spectacular technical disaster does not mean that the rollout is going smoothly. The centre of gravity of the challenges has shifted from the state infrastructure directly to offices and companies. Businesses that had previously relied on paper documents or simple PDF files had to face real-time reporting and a thorough overhaul of their internal processes almost overnight.
The main operational challenges after the KSeF rollout
The nature of the problems reported by businesses has changed dramatically. Instead of questions about the availability of the system itself, companies now focus on practical issues related to day-to-day operation in the new model. The most common concerns cover several key areas.
- Access to the system and granting permissions - the KSeF access certificate gives insight into all of a company's purchase and sales transactions, so it requires deliberate management of the permissions structure.
- Corrections and no option to withdraw a document - every invoice sent to the system immediately receives a unique identification number and a timestamp, and even a minor typo forces an official correction procedure.
- Organisation of document flow - companies must redefine their internal accounting processes to adapt them to KSeF requirements.
- Invoice dating and the end of backdating - the previous practice of issuing documents with a retrospective date or "tidying up" the month has been eliminated.
- Emergency mode - businesses must know when they can issue an invoice offline and within what deadline they must submit it to the central database.
Each of these points requires not only knowledge of the regulations, but also the ability to apply them to the specific business model of the company. This is precisely where professional legal and tax advice becomes invaluable support.
KSeF legal pitfalls - limits, exemptions and emergency mode
Exemption limits - what to watch out for?
The legislator provided a buffer for the smallest entities whose monthly value of sales documented by invoices does not exceed a specified threshold. However, it is crucial that sales to consumers (B2C) and transactions recorded on cash registers do not count towards this limit. Importantly, exceeding the threshold even once means irreversibly moving into mandatory KSeF - for all subsequent documents, with no way back.
In practice, this means that businesses running a sole proprietorship (JDG) and small companies must continuously monitor the value of the B2B invoices they issue. Unknowingly exceeding the limit may result in an obligation to adapt processes to the system's requirements retroactively.
Specific business models and KSeF
Particular doubts arise in situations involving VAT-exempt services, the distinction between receipts and invoices covered by the KSeF obligation, and the correct markings in tax records. Companies are no longer looking for general explanations - they need specific answers tailored to their individual legal situation.
It is worth emphasising that the Ministry of Finance has announced a transitional period during which no penalties will be imposed for errors in using the system. This gives companies valuable time to learn, but it does not remove the need for a thorough overhaul of document management processes. Every month of delay in putting procedures in order means a growing risk of problems once the protection period ends.
What next for KSeF? Planned changes and upcoming functionalities
The Ministry of Finance is not closing the system's architecture. In the coming months, further functionalities are planned to streamline day-to-day work with the platform. The most important announced changes include:
- Simplification of the procedure for reporting scam invoices via the API interface - particularly important for companies using external accounting software.
- An option to hide documents that are not subject to VAT deduction - a long-awaited functionality that will tidy up the view of documents in the system.
- A collective identifier for payment automation - a solution that in the longer term may significantly improve financial processes.
Experts stress that the adaptation phase will last a long time yet. After every break - whether holiday or vacation - the topic of KSeF returns with greater intensity and in an increasingly practical dimension. The coming weeks and months will be crucial in assessing whether the system created by the tax administration really fits the realities of running a business in Poland.
