The government is announcing a far-reaching reform of the labour market, intended to curb self-employment. Some B2B contracts - especially those concluded between sole proprietorships and large companies - are to be formally reclassified as employment contracts.
Officially, the aim is "levelling the playing field and tightening the system". In practice, it is about increasing budget revenue.
For thousands of business owners, particularly in the IT, transport and services sectors, this means a real risk of higher costs, a loss of flexibility and closer fiscal oversight.
What the government is planning
According to the announcements, the state expects billions in revenue from the new reform.
Analyses indicate that as many as 150,000-200,000 self-employed people could be subject to inspection and forced to change the form of their cooperation.
The plan also includes:
- expanding the powers of the National Labour Inspectorate (PIP),
- automatic transfer of data from the Social Insurance Institution (ZUS), the National Revenue Administration (KAS) and tax offices,
- algorithmic analysis of contracts to detect self-employment risks,
- treating as "sham B2B" any relationship involving subordination and a fixed place of service delivery.
Why this matters to you
If you run a sole proprietorship and work mainly with one client, you may be deemed to be "hiding an employment relationship".
For the tax authorities it is a simple equation: one invoice a month = one employee.
This means higher charges, a loss of freedom to operate and the risk of back-dated social security contributions and taxes being assessed.
Our antidote - proven and effective
At Global Tax Partners we have prepared a set of solutions that allow you to retain B2B flexibility and legal certainty.
We work so that your business is resilient to changes in the rules - regardless of which model the government chooses.
How we work:
- We analyse your situation - contracts, relationships with counterparties, connections, revenue structure.
- We create a new cooperation model - e.g. a move to a UK Ltd company, a limited liability company (sp. z o.o.) or a holding structure.
- We design defensive documentation - demonstrating the genuine independence of your business.
- We secure you for tax and formal purposes - so that no authority can challenge the form of your business.
Our comment
This is not an ordinary change in the rules. It is a change in philosophy - trust in the business owner is giving way to fiscal control.
But where others see a threat, we see a solution.
With us, you do not have to wait for someone else to decide for you.
